Without wanting to get into the specifics of what's happened with A Lonely Place For Dying (we'll put up a blogpost about the situation, what we've learned from it, and we intend to go on, as soon as possible), I can say that we've been in communication with Justin and his team to try to rectify any problems & reach an agreement to continue the distribution. Our understanding as of a couple days ago is that they now want to go the theatrical route, but that they will honour the commitments they made to donors of part one. We have indeed seen problems with the serialised model here, but like I say we'll do a full post mortem on our blog. Apologies for the SNAFU.

I don't think that it was discluded from the list; afaik, it just barely failed to scrape in on the stats that they had that week. I do know that TorrentFreak doesn't exclude on ideological grounds -- STEAL THIS FILM II made it in, for example, back in the day.
